Terms of Service

1. Agreement to Terms

By accessing or using ServeSwift (the “Service”), operated by ServeSwift Incorporated (“ServeSwift,” “we,” “us,” or “our”), a Delaware corporation, you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at admin@serveswift.ai.

Each account belongs to an organization (“Org”). Certain actions — including data deletion requests — apply at the Org level and affect all members of that Org.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Transmit any malicious code, viruses, or harmful content through the Service
  • Use the Service to infringe on the intellectual property rights of others
  • Resell, sublicense, or otherwise commercialize access to the Service without our written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the e-signature features to forge, misrepresent, or fraudulently execute documents

5. Plans, Credits, and Billing

ServeSwift offers a free tier and paid subscription plans (together, the “Plans”). Features available under each Plan are described on our pricing page and may change over time with reasonable notice.

Free Plan

The Free plan includes:

  • 5 AI generation credits per month
  • 1 user (no team members)
  • Up to 100 contacts and 20 accounts
  • Up to 250 logged activities
  • 3 native e-signature sends per month

Pro Plan

The Pro plan includes:

  • 100 AI generation credits per month per seat, shared across all team members
  • Unlimited contacts, accounts, activities, and team members
  • Unlimited native e-signature sends
  • 1 Dropbox Sign send per month (via ServeSwift's shared account)
  • Ability to connect your own Dropbox Sign account for unlimited sends
  • Full access to all features

Business Plan

The Business plan includes everything in Pro, plus:

  • 200 AI generation credits per month per seat
  • 3 Dropbox Sign sends per month (via ServeSwift's shared account)

AI Credit Top-Ups

Pro and Business plan subscribers may purchase additional AI generation credits. Top-up credits expire at the end of the current billing period and do not carry over to the next period.

E-Sign Bundles

Any subscriber (including Free plan) may purchase additional Dropbox Sign sends in bundles of 5 for $15. Unlike monthly AI credits, e-sign bundle sends never expire and stack with your monthly allowance.

Credit Expiry

Monthly AI generation credits expire at the end of each billing period and reset at the start of the next. Unused monthly credits do not roll over. E-sign bundle credits do not expire.

Billing

Paid plans are available on a monthly or annual billing cycle. Annual plans are billed upfront for the full year. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid plan features and credits through the end of your current billing period. At the end of that period, your account will revert to the Free tier.

Refunds

All payments are non-refundable. We do not provide refunds for partial billing periods, unused credits, or unused time remaining after cancellation. You will continue to have access to the Service through the end of your paid billing period.

6. Electronic Signatures

ServeSwift provides a native e-signature feature and, as an optional integration, access to Dropbox Sign. By using either feature to send or sign documents, you acknowledge and agree to the following:

Legal Validity

Electronic signatures executed through the Service are intended to comply with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA), where applicable. By checking the consent checkbox and clicking “Sign Document,” a signer agrees that their electronic signature is the legal equivalent of a handwritten signature.

Sender Responsibility

You are responsible for ensuring that (a) signers have consented to receive documents electronically, (b) the documents you send for signature are accurate and lawful, and (c) you have the right to collect signatures on those documents. ServeSwift is a technology platform and is not a party to any contract or agreement executed through the Service.

Audit Trail

When using native e-sign, ServeSwift records an audit trail including the signer's IP address, browser information, and timestamps for each action (sent, viewed, signed, declined). This audit trail is stored alongside the signed document and is accessible to the sending organization.

Document Integrity

ServeSwift uses SHA-256 hashing to detect if a contract's content is altered after it has been sent for signature. Any attempt to tamper with a document after dispatch will cause the signing process to fail.

7. Third-Party Integrations

The Service allows you to connect third-party accounts including Gmail, Microsoft 365 (Outlook), and Dropbox Sign. By connecting these integrations, you:

  • Authorize ServeSwift to access your account on that platform with the permissions you grant during the OAuth authorization flow
  • Agree to the third party's own terms of service and privacy policy, which govern that service independently
  • Acknowledge that ServeSwift is not responsible for the availability, accuracy, or security of any third-party service

You may revoke ServeSwift's access to any connected account at any time, either through the Settings page in ServeSwift or directly through the third party's account settings.

Email data: When you connect Gmail or Outlook, ServeSwift accesses your email data solely to log emails as CRM activities and to enable sending emails from within the Service. We do not use email data for advertising, training AI models, or any purpose beyond what is disclosed in our Privacy Policy.

8. Data and Account Termination

Your Data

You retain ownership of all data you input into the Service, including information about your clients, contracts, and projects.

Account Cancellation

If you cancel your subscription or downgrade to the free tier, your data remains in the Service. We do not automatically delete data upon cancellation.

Data Deletion

If you wish to have your data permanently deleted, an authorized administrator of your Org must submit a deletion request to admin@serveswift.ai. Deletion requests apply to the entire Org and all associated data. Upon receiving a valid request, we will permanently delete your Org's data within 30 days and confirm once complete.

Termination by ServeSwift

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. In the event of termination for cause, no refund will be issued.

9. Intellectual Property

The Service, including its design, software, and content, is owned by ServeSwift Incorporated and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology.

You grant ServeSwift a limited license to store, process, and display your data solely as necessary to provide the Service to you.

10. AI-Powered Features

Certain features of the Service are powered by third-party AI APIs. By using these features, you acknowledge that limited data (such as names associated with your clients or contracts) may be transmitted to third-party AI providers for processing. You represent that you have the right to submit any data you provide through these features.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. ServeSwift does not provide legal advice. Documents and e-signatures generated through the Service do not constitute legal advice, and you should consult a qualified attorney for any legal questions.

12. Limitation of Liability

To the fullest extent permitted by law, ServeSwift Incorporated shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to ServeSwift in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
