Terms of Service

1. Agreement to Terms

ServeSwift (the “Service”) is run by ServeSwift Incorporated (“ServeSwift,” “we,” “us,” or “our”), a Delaware corporation. When you access or use the Service, you agree to be bound by these Terms of Service (“Terms”). If you are signing up on behalf of a company, you are telling us you have the authority to bind that company to these Terms.

If you do not agree with them, please do not use the Service.

2. Eligibility

You need to be at least 18 to use the Service. By using it, you are confirming that you are.

3. Accounts

Keeping your account credentials private is on you, and so is everything that happens under your account. If you spot any unauthorized use, tell us right away at admin@serveswift.ai.

Every account lives inside an organization (“Org”). Some actions, data deletion requests among them, happen at the Org level and affect everyone in that Org.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Transmit any malicious code, viruses, or harmful content through the Service
  • Use the Service to infringe on the intellectual property rights of others
  • Resell, sublicense, or otherwise commercialize access to the Service without our written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the e-signature features to forge, misrepresent, or fraudulently execute documents

5. Plans, Credits, and Billing

We offer a free tier and paid subscription plans (together, the “Plans”). What each Plan includes is spelled out on our pricing page, and it can change over time. When it does, we will give you reasonable notice first.

Free Plan

The Free plan includes:

  • 5 AI generation credits per month
  • 1 user (no team members)
  • Up to 100 contacts and 20 accounts
  • Up to 250 logged activities
  • 3 native e-signature sends per month

Pro Plan

The Pro plan includes:

  • 100 AI generation credits per month per seat, shared across all team members
  • Unlimited contacts, accounts, activities, and team members
  • Unlimited native e-signature sends
  • 1 Dropbox Sign send per month (via ServeSwift's shared account)
  • Ability to connect your own Dropbox Sign account for unlimited sends
  • Full access to all features

Business Plan

The Business plan includes everything in Pro, plus:

  • 200 AI generation credits per month per seat
  • 3 Dropbox Sign sends per month (via ServeSwift's shared account)

AI Credit Top-Ups

If you are on Pro or Business, you can buy extra AI generation credits whenever you need them. Note that top-up credits expire at the end of the current billing period and do not carry over to the next one.

E-Sign Bundles

Anyone, Free plan included, can buy extra Dropbox Sign sends in bundles of 5 for $15. Unlike monthly AI credits, these never expire, and they stack on top of whatever your monthly allowance already gives you.

Credit Expiry

Monthly AI generation credits expire at the end of each billing period and start fresh at the beginning of the next. Anything you did not use does not roll over. E-sign bundle credits are the exception, and they do not expire.

Billing

You can pay monthly or annually. Annual plans are billed upfront for the full year. Either way, subscribing means you are authorizing us to charge your payment method on a recurring basis until you decide to cancel.

Cancellation

You can cancel anytime. When you do, you keep your paid features and credits through the end of the billing period you already paid for. After that, your account drops back to the Free tier.

Refunds

All payments are non-refundable. That means we do not refund partial billing periods, unused credits, or time left over after you cancel. You will, however, keep access to the Service through the end of the period you paid for.

6. Electronic Signatures

We give you a native e-signature feature, plus optional access to Dropbox Sign if you prefer it. Whenever you use either one to send or sign documents, here is what you are agreeing to:

Legal Validity

Electronic signatures executed through the Service are intended to comply with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA), where applicable. By checking the consent checkbox and clicking “Sign Document,” a signer agrees that their electronic signature is the legal equivalent of a handwritten signature.

Sender Responsibility

When you send something for signature, a few things are on you: (a) that your signers have agreed to receive documents electronically, (b) that the documents themselves are accurate and lawful, and (c) that you have the right to collect signatures on them. We are the technology underneath. We are not a party to any contract or agreement executed through the Service.

Audit Trail

With native e-sign, we record an audit trail behind the scenes: the signer's IP address, browser information, and timestamps for every step (sent, viewed, signed, declined). It is stored right alongside the signed document, and the organization that sent it can see it.

Document Integrity

We use SHA-256 hashing to catch any change to a contract's content after it goes out for signature. If someone tampers with a document once it has been sent, the signing process simply fails.

7. Third-Party Integrations

The Service lets you connect third-party accounts like Gmail, Microsoft 365 (Outlook), and Dropbox Sign. When you connect one of these, you are doing a few things:

  • Authorize ServeSwift to access your account on that platform with the permissions you grant during the OAuth authorization flow
  • Agree to the third party's own terms of service and privacy policy, which govern that service independently
  • Acknowledge that ServeSwift is not responsible for the availability, accuracy, or security of any third-party service

You can pull our access to any connected account whenever you want, either from the Settings page in ServeSwift or straight from the third party's own account settings.

Email data: When you connect Gmail or Outlook, we access your email for two reasons only: to log emails as CRM activities and to let you send email from inside the Service. We do not use it for advertising, we do not train AI models on it, and we do not do anything with it beyond what our Privacy Policy already spells out.

8. Data and Account Termination

Your Data

Everything you put into the Service stays yours: your clients, your contracts, your projects, all of it. Ownership does not transfer to us.

Account Cancellation

Cancel or drop to the free tier and your data stays put. We do not delete anything automatically when you cancel.

Data Deletion

If you do want your data gone for good, an authorized administrator of your Org needs to send a deletion request to admin@serveswift.ai. These requests cover the whole Org and everything tied to it. Once we have a valid request, we will permanently delete your Org's data within 30 days and confirm when it is done.

Termination by ServeSwift

We can suspend or terminate an account if someone breaks these Terms or does something we judge to be harmful to the Service or to other users. If we terminate an account for cause, no refund is issued.

9. Intellectual Property

The Service itself, its design, software, and content, belongs to ServeSwift Incorporated and is protected by intellectual property laws. Nothing in these Terms gives you any rights to our trademarks, logos, or proprietary technology.

For your part, you grant us a limited license to store, process, and display your data, but only as far as we need to in order to run the Service for you.

10. AI-Powered Features

Some features run on third-party AI APIs. When you use them, a limited amount of data (things like the names tied to your clients or contracts) may be sent to those AI providers to do the work. By using these features, you are confirming that you have the right to submit whatever data you put through them.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. ServeSwift does not provide legal advice. The documents and e-signatures you generate through the Service do not constitute legal advice, so for any legal question, please consult a qualified attorney.

12. Limitation of Liability

To the fullest extent permitted by law, ServeSwift Incorporated shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to ServeSwift in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

14. Changes to These Terms

We will update these Terms now and then. When something material changes, we will let you know by email or with a notice inside the Service. If you keep using the Service after the changes take effect, you are accepting the updated Terms.
